Synopsis | For the purpose of repealing certain provisions of law related to the disclosure of certain payments to certain candidates and elected officials in Montgomery County and certain penalties; prohibiting an applicant or an applicant’s agent from making a payment to an elected official in Montgomery County, or a slate that includes an elected official, during the pendency of a certain application; prohibiting an elected official from voting or participating in a proceeding on a certain application if certain persons received a payment during a certain period, subject to certain exceptions; requiring an applicant or an applicant’s agent to file a certain affidavit related to payments involving an elected official; requiring that a certain affidavit be filed at least a certain number of days before the consideration of the application; providing for the application of certain provisions of this Act; prohibiting an applicant and an applicant’s agent from taking certain action to circumvent the intent of certain provisions of this Act; requiring the disclosure of certain ex parte communications between certain persons; requiring certain persons to file a certain disclosure regarding certain ex parte communications with a certain clerk within a certain time period; authorizing a party of record to file evidence of a certain payment or ex parte communication with a certain clerk; providing for the duties and powers of a certain clerk in the enforcement of certain provisions of this Act; establishing certain disclosure and affidavit filing requirements for certain corporations and any subsidiary of certain corporations; requiring a certain clerk to prepare a certain report at least a certain number of times each year; requiring that certain summary reports be available to members of the public on written request; authorizing the Montgomery County Ethics Commission or other aggrieved persons to pursue certain judicial remedies for certain violations of law; authorizing a court to issue a certain order or take other certain actions under certain circumstances; establishing certain penalties; requiring certain persons to preserve certain documents for a certain number of years; requiring certain documents to be available for public inspection after reasonable notice; requiring that certain provisions of law be carried out in accordance with this Act; defining certain terms; altering certain definitions; repealing a certain defined term; and generally relating to public ethics and Montgomery County. |
